1. Acceptance of Terms

By accessing or using SwipePost ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and SwipePost ("we", "our", or "us").

2. Description of Service

SwipePost is an AI-powered social media content platform that helps business owners create, schedule, and publish social media posts, images, ads, and video content. The Service includes:

• AI-generated text and image content tailored to your brand
• A content calendar for planning and scheduling posts
• An AI agent assistant for conversational content creation
• A Creative Studio for designing advertisements
• Integration with social media platforms (Instagram, X/Twitter, LinkedIn, Facebook, YouTube) for publishing
• Integration with Meta Ads for launching ad campaigns
• Analytics and trend insights

3. Account Registration

To use SwipePost, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account, and to update it as necessary. You must be at least 13 years of age to use the Service.

4. Plans, Billing, and Generations

SwipePost offers three plans: Free, Pro ($12/month), and Ultimate ($39/month). Each plan includes a monthly pool of generations and a limit on AI agent messages.

Generations: A generation is consumed each time you create an image or ad (1 generation each) or a video short (3 generations per 10-second segment). Generations reset on a rolling 30-day cycle from your signup or first usage date.

Paid subscriptions are billed monthly through Stripe. You may upgrade, downgrade, or cancel at any time from your Settings page. Upon cancellation, you retain access to paid features until the end of your current billing period. No refunds are issued for partial months.

We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate until their next renewal after the notice period.

5. Acceptable Use

You agree not to use SwipePost to:

• Generate, store, or distribute content that is illegal, defamatory, harassing, threatening, or hateful
• Create spam, misleading, or deceptive content for social media
• Impersonate any person, business, or entity
• Infringe on the intellectual property rights of others
• Attempt to bypass usage limits, reverse engineer, or interfere with the Service
• Use automated bots or scripts to access the Service (outside of authorized API integrations)
• Upload malware, viruses, or any harmful code
• Violate the terms of any connected social media platform

We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice.

6. AI-Generated Content

Content generated by SwipePost's AI tools (including text, images, and ads) is created using third-party AI models. While we strive for high-quality, brand-aligned output:

• No guarantee of accuracy: AI-generated content may contain errors, inaccuracies, or unintended language. You are responsible for reviewing all content before publishing.
• Ownership: You retain ownership of the content you create and publish using SwipePost. However, you grant us a limited license to store and process your content as necessary to provide the Service.
• No exclusivity: AI models may generate similar content for other users. Generated content is not guaranteed to be unique.

You are solely responsible for ensuring that any content you publish complies with applicable laws, platform guidelines, and third-party rights.

7. Connected Social Media Accounts

When you connect social media accounts (Instagram, X, LinkedIn, Facebook, YouTube), you authorize SwipePost to access, read, and publish content on your behalf according to the permissions you grant.

You are responsible for all content published through SwipePost to your social media accounts. SwipePost is not liable for any consequences arising from content you choose to publish, including ad campaigns launched through our Meta Ads integration.

You may disconnect any social media account at any time from your Settings page.

8. Advertising Campaigns

SwipePost allows you to create and launch advertising campaigns through Meta Ads. When you launch a campaign:

• You are the advertiser and are responsible for the ad content and targeting
• Ad spend is charged directly by Meta to your connected ad account, not by SwipePost
• SwipePost does not guarantee any specific advertising results, impressions, or return on ad spend
• You must comply with Meta's Advertising Policies and all applicable advertising laws

9. Data Retention

We retain your content based on your plan tier:

• Free: Saved posts retained for 90 days; conversations for 30 days
• Pro: Saved posts retained for 180 days; conversations for 90 days
• Ultimate: Saved posts retained for 1 year; conversations for 1 year

Discarded posts are automatically deleted after 3 days. For full details on data handling, please see our Privacy Policy.

10. Intellectual Property

The SwipePost platform, including its design, code, logos, and branding, is the intellectual property of SwipePost. You may not copy, modify, distribute, or reverse engineer any part of the Service.

You retain all rights to content you create using SwipePost (text, images, ads, video). By using the Service, you grant us a non-exclusive, worldwide license to store, process, and display your content solely to provide the Service.

11. Limitation of Liability

SwipePost is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, SwipePost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may terminate your account at any time by contacting us or through your Settings page. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a paid subscription.

Upon termination, your access to the Service will cease and your data will be deleted in accordance with our data retention policies, unless retention is required by law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

For significant changes to pricing or service scope, we will provide at least 30 days' notice via email or in-app notification.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
